Welcome to NicheNova. These Terms of Service govern your use of our website and purchases made through our online store.

Throughout these Terms, “NicheNova”, “we”, “us” and “our” refer to the business operating the NicheNova store.

By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms affects any rights you have under UK consumer law.

1. Using our store

You must use our website and services lawfully.

When placing an order, you agree to provide accurate, current and complete information, including your name, email address, billing details and delivery address.

You are responsible for checking that the information supplied with your order is correct.

If you use a customer account, you are responsible for keeping your account details and login information secure.

2. Our products

We make reasonable efforts to describe and display our products accurately.

However, colours and appearance may vary slightly depending on your screen, device and lighting.

Where temporary or illustrative product imagery is used, the product description and information provided at the time of purchase will form part of your order.

All goods supplied to UK consumers remain subject to their statutory rights, including the requirement for goods to be as described, of satisfactory quality and fit for purpose where applicable.

We may update, discontinue or limit products from time to time, provided this does not affect orders we have already accepted.

3. Orders

Placing an order constitutes an offer to purchase products from NicheNova.

After you place an order, you will normally receive an electronic confirmation acknowledging that we have received it.

We reserve the right to refuse or cancel an order before fulfilment where reasonably necessary, including because of stock availability, incorrect pricing, suspected fraud, payment problems or an inability to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid.

Nothing in these Terms restricts your statutory cancellation, return, refund, repair or replacement rights.

4. Prices, promotions and payment

Prices shown on the NicheNova store are displayed in pounds sterling unless otherwise stated.

UK prices include applicable taxes where required. Any delivery charge payable will be shown before you complete your purchase.

The price charged will be the price displayed at checkout when you place your order, subject to correction of an obvious pricing or technical error before the order is accepted.

From time to time we may offer promotions, discounts or bundle offers. Additional conditions may apply to a particular promotion and will be displayed where relevant.

Discounts cannot be combined unless expressly stated otherwise.

You must be authorised to use the payment method supplied for your purchase.

5. Shipping and delivery

Our current delivery options, charges and other shipping information are explained in our Shipping & Delivery Policy and at checkout where applicable.

Delivery dates and times may be estimates unless we expressly agree a specific delivery date with you.

We are responsible for the goods while they are in transit using a delivery service arranged by us. Risk normally passes to you when you, or a person identified by you, takes physical possession of the goods.

This does not apply where you independently arrange a carrier that was not offered by us, in circumstances where the law provides otherwise.

6. Returns, cancellations and faulty goods

Our voluntary return arrangements and information about cancelling an online order are set out in our Returns & Refunds Policy.

UK consumers have statutory rights that exist separately from any voluntary NicheNova return policy.

These include rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods.

Nothing in these Terms or our other policies is intended to exclude or reduce rights that cannot legally be excluded.

7. Intellectual property

Unless otherwise stated, the NicheNova website, branding, logos, graphics, written content and original creative material are owned by or licensed to NicheNova.

You may use our website for personal and non-commercial purposes.

You must not reproduce, copy, distribute, commercially exploit or materially modify NicheNova-owned content without permission, except where permitted by law.

Shopify and other third-party names, trademarks and content remain the property of their respective owners.

8. Third-party services and links

Our store may use services provided by third parties, including Shopify, payment providers, delivery companies, marketing services and other technology providers.

Third-party websites and services may have their own terms and privacy policies.

Where we provide a link to a third-party website, we are not responsible for the content or operation of that website.

This does not exclude responsibility that we are legally required to accept for companies, agents or subcontractors used by us to perform our obligations to you.

9. Shopify

Our online store is powered by Shopify.

Purchases from the NicheNova store are made from NicheNova, not Shopify.

Shopify provides ecommerce technology and related services that enable us to operate the store but is not the seller of the NicheNova products you purchase from us.

10. Privacy

Personal information is handled in accordance with our Privacy Policy.

Our store is hosted using Shopify, which processes certain information in order to provide the ecommerce services we use.

Other service providers may also process information where necessary to operate the store, take payments, fulfil orders, provide customer support or perform other legitimate business functions.

11. Errors and availability

Occasionally our website may contain an error relating to product information, availability, pricing, promotions, delivery charges or other information.

We may correct genuine mistakes when they are discovered.

Where an error materially affects an order that has not yet been fulfilled, we will contact you where appropriate and give you the available options, which may include cancellation and a refund.

12. Prohibited use

You must not use our website:

• for unlawful or fraudulent activity;
• to infringe intellectual property or privacy rights;

We are not responsible for delay or failure caused solely by events outside our reasonable control where we have taken reasonable steps to minimise the effect.

This may include serious courier disruption, natural disasters, industrial disruption or failures of infrastructure outside our control.

Your legal rights regarding delivery, cancellation and refunds remain unaffected.

We may update these Terms from time to time.

The version applicable to an order will generally be the version in effect when that order was placed.

Changes to these Terms will not remove contractual or statutory rights relating to an order that has already been made.

16. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

17. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory consumer protections available to you and may have rights to bring proceedings in the courts where you live.

Nothing in these Terms is intended to restrict any mandatory rights regarding where a consumer may bring a claim.
